Conditions governing the use of Core Competent's services

These Terms of Service ("Terms") govern the contractual relationship between Core Competent, S.C. ("Core Competent", "we", or "the Firm"), with registered office at El Blvd. Antonio Rocha Cordero #155, San Luis Potosí, S.L.P., CP 78380, Mexico, and its clients, users, and prospects ("Client" or "you") who access this website or engage any of our professional services.

By accessing the website corecompetent.mx or by requesting or engaging our services, you agree to be bound by these Terms. If you do not agree with any of the conditions set forth herein, please refrain from using our services.

1. Description of Services

Core Competent is a consulting firm specializing in talent and organizational development. Our services include, but are not limited to:

  • Executive Search: Search and selection of C-level and senior executive talent through a systemic methodology and comprehensive evaluation.
  • Executive Coaching: Individual and group leadership development processes for executives and high-performance teams.
  • Organizational Consulting: Diagnosis, structural design, and support throughout organizational transformation processes.
  • Organizational Development: Culture, team, and talent development programs with a systemic approach.

The scope, deliverables, and specific conditions of each service are established in the proposal or service agreement executed between the parties.

2. Use of the Website

Access to and use of this website is granted on a temporary and free-of-charge basis. Core Competent reserves the right to withdraw or modify site content without prior notice. By using this site, you agree to:

  • Not use the site in any way that causes or may cause damage to it, or that affects the availability or accessibility of the site.
  • Not use the site in an illegal, fraudulent, or unauthorized manner.
  • Not collect or extract data from the site without our express written authorization.
  • Not reproduce, duplicate, copy, or resell any part of the site without our express written authorization.

3. Intellectual Property

All content published on this website, including but not limited to texts, images, logos, methodologies, studies, infographics, and graphic elements, is the exclusive property of Core Competent or its respective rights holders, and is protected by applicable intellectual property laws in Mexico and abroad.

The reproduction, distribution, modification, or commercial use of any content from this site without prior written authorization from Core Competent is expressly prohibited.

4. Confidentiality

In the course of providing our services, Core Competent commonly has access to confidential and sensitive information from the Client, including strategic, organizational, financial, and human resources information. Core Competent undertakes to:

  • Treat all Client information with the strictest confidentiality.
  • Not disclose such information to third parties without the Client's prior written consent, unless required by law.
  • Implement reasonable security measures to protect confidential information.

Confidentiality obligations shall survive for a period of three (3) years from the termination of the relevant engagement, unless the parties agree otherwise in the service agreement.

5. Limitation of Liability

Core Competent provides its services with the highest level of professionalism and diligence. However, to the extent permitted by law:

  • Core Competent does not guarantee specific outcomes or the future performance of candidates presented or individuals undergoing coaching.
  • Core Competent's liability for direct damages arising from its services shall be limited to the amount of fees actually paid for the service in question.
  • Core Competent shall not be liable for indirect damages, loss of profits, loss of data, or any other consequential damages.
  • The information and content on this website are provided "as is", without warranties of any kind, express or implied.

6. Executive Search Guarantee Policy

Unless the service agreement establishes different conditions, Core Competent offers a candidate replacement guarantee for Executive Search engagements under the following terms:

  • If the finalist candidate voluntarily leaves the position or is dismissed for reasons attributable to the search within the first ninety (90) calendar days of joining, Core Competent will initiate a new search process at no additional base fee.
  • This guarantee does not apply if the separation arises from causes unrelated to the evaluated profile, such as restructuring, position elimination, or changes in the company's strategic direction.

7. Fees and Payment Conditions

Professional fees, payment conditions, and timelines will be specifically established in each proposal or service agreement. As a general policy:

  • Fees will be quoted in Mexican Pesos (MXN) unless otherwise agreed.
  • Invoices will be issued in accordance with current Mexican tax requirements (CFDI).
  • Failure to make timely payments may result in the suspension of services and the assessment of late-payment interest.

8. Personal Data Protection

The processing of personal data carried out by Core Competent in connection with the use of this site and the provision of its services is governed by our Privacy Policy, which forms an integral part of these Terms and has been prepared in accordance with Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.

9. Amendments to the Terms

Core Competent reserves the right to modify these Terms at any time. Changes will take effect upon publication on this website. Continued use of the services or website following the posting of changes will constitute your acceptance of those changes. We recommend reviewing this page periodically.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. For any disputes arising from the interpretation, performance, or breach of these Terms, the parties expressly submit to the jurisdiction of the competent courts of the city of San Luis Potosí, S.L.P., Mexico, waiving any other jurisdiction that may apply by reason of their current or future domiciles or for any other cause.
